Who Can Appeal a Criminal Verdict?
To overturn your criminal verdict in Virginia, you will need to prove that your rights were somehow violated or the case mishandled. In other words, you must have a concrete legal reason, or ground, for appealing a verdict. You can base an appeal on procedural grounds or on the violation of a legal right, such as:
- The evidence was not enough to convict you of the crime.
- The evidence used was obtained illegally.
- The jury was incorrectly advised or instructed.
Appeals are extremely time-sensitive, so consult with an attorney immediately if you have been convicted.
The Criminal Appeals Process
The appeals process can be confusing and riddled with complex technical steps that cannot be overlooked. Failing to follow the proper procedure in filing an appeal can result in it being dismissed without consideration. For example, if you were convicted in a Virginia district court, you have only 10 days to begin the appeal. If you were convicted in a Virginia circuit court, you have only 30 days to appeal. If you were sentenced in federal court, you only have 14 days to begin the appeal.
